CPSC Proposed Rule on High Chairs

On November 9, 2015, the U.S. Consumer Product Safety Commission (CPSC) is proposing a new federal regulation: 16 CFR 1231 Safety Standard for High Chairs.  The rule proposes to adopt the existing ASTM standard F404 – 15 Standard Consumer Safety Specification for Children’s Chairs and Stools, with a few modifications to the rearward stability test and the requirements for warnings. Comments on the proposed rule can be submitted unitl January 25, 2016.  The commission proposes that the rule become effective 6 months from the date it is finalized and published in the federal register.

EU Restricts Additional Chemicals in Toys

On November 24, 2015, the EU published directives 2015/2115, 2015/2116, and 2015/2117 restricting the use of certain chemics in toys for under 36 months and other toys intended to be placed in the mouth. The five chemicals are: 

1.  1,2-Benzisothiazol- 3(2H)-one (BIT, CAS 2634-33-5), used as a preservative in water-based toys and hobby paints, effective May 24, 2017, with a limit of ≤ 5 mg/kg

2.  5-Chloro-2-methylisothiazolin-3(2H)-one (CMI) and 2-methylisothiazolin-3(2H)-one (MI) (CMI:MI = 3:1, CAS 55965-84-9), used as a preservative in water-based toys and hobby paints, effective November 24, 2017, with a limit of ≤ 1 mg/kg

3.  5-Chloro-2-methylisothiazolin-3(2H)-one (CMI, CAS 26172-55-4), used as a preservative in water-based toys and hobby paints, effective November 24, 2017, with a limit of ≤ .75 mg/kg

4.  2-Methylisothiazolin-3(2H)-one (MI, CAS 2682-20-4), used as a preservative in water-based toys and hobby paints, effective November 24, 2017, with a limit of ≤ .25 mg/kg

5.  Formamide (CAS 75-12-7), often used in the manufacture of foams, such as soft foam mats, effective May 24, 2017, with a limit of ≤ 200 mg/kg
