Minnesota – First State to Regulate Cadmium in Children’s Jewelry

Minnesota has finalized a law for cadmium in children’s jewelry, making it the first state to enforce cadmium regulations.
This comes on the heels of the Associated Press investigation of excessive levels of cadmium in children’s jewelry being sold in the U.S. and the Consumer Product Safety Commission (CPSC) recalls of several jewelry products.

The Minnesota law states that Cadmium in any surface coating or accessible substrate material of metal or plastic components of children’s jewelry shall not exceed 75 parts per million and shall be tested in accordance with the heavy metals test method defined in ASTM F963.
The sale or distribution of jewelry through a nonprofit organization or an isolated or occasional sale that is not made in the normal course of business are exempt from these requirements.

The requirements become effective for manufacturers and wholesalers on January 1, 2011 and for retailers on March 1, 2011.
